The complainant claims the grilling was “deliberate” to annoy her
At some point in time, you’ve probably had beef with a neighbor over some loud music or a parking spot, but what if you had beef with a neighbor over beef, literally?
One woman certainly did (among other things) and decided to sue partly over their decision to grill outside. Cilla Carden, a vegan from Perth, Australia, told local news that she was frustrated over her neighbors’ decision to grill meat outside in their yard, making it impossible for her to go outside.
“They’ve put it there so I smell fish, all I can smell is fish. I can’t enjoy my backyard, I can’t go out there,” Carden said.
She believes the grilling was “deliberate.”
In her lawsuit, Carden also claimed she was irritated by cigarette smoke and the sounds of children playing basketball. Her neighbors told local news that they removed the grill and the basketball hoop.
Carden’s request were rejected by the State Administrative Tribunal of Western Australia. She appealed that decision and the appeal was denied as well.
“The Tribunal does not accept that the parents, by allowing their children to play in the backyard…use the patio for small scooters or toys, constitutes reasonably a nuisance,” the initial rejection read: “What they are doing is living in their backyard and their home as a family.”
Despite losing the first time, Carden is adamant on continuing her legal fight. As a result, people are planning a BBQ in her honor as a way to troll Carden.
The Facebook event reads “Community BBQ for Cilla Carden” and will be held on October 19, in Perth, in case you’re interested. So far, more than 4,000 people have RSVPed.
